This negligence action arose from a fatal boating accident involving the collision of two boats on Fox Lake at around 11:10 p.m. on June 15, 1991. Defendant's decedent, Eugene Seitz (hereinafter defendant), was operating one of the boats (defendant's boat) and was killed in the accident.
