BYRNES, Judge.

On March 7, 1996, the defendant was charged with one count of second degree murder, a charge to which he has pled not guilty. His motion to suppress the statement was heard and granted on May 21st. The State sought writs, and on review this court reversed the trial court's ruling and remanded the case for further proceedings, holding that: "The defendant is entitled to waive the presence of counsel even if counsel does not agree or is not present."...
