Defendant appeals as of right his convictions by a jury of assault with intent to commit criminal sexual conduct involving sexual penetration, M.C.L. § 750.520g; M.S.A. § 28.788(7), and fourth-degree criminal sexual conduct, M.C.L. § 750.520e(1)(a); M.S.A. § 28.788(5)(1)(a). Defendant subsequently pleaded guilty of being a third-offense habitual offender, M.C.L. § 769.11; M.S.A. § 28.1083, and was sentenced to concurrent terms...
