OPINION

DAVIS, Chief Justice.

A jury convicted Appellant Javier Sendejo a/k/a Harvey1 of capital murder. See Tex. Penal Code Ann. § 19.03(a)(2) (Vernon 1994). Because the State waived the death penalty, the court sentenced Sendejo to confinement for life in the Institutional Division of the Texas Department of Criminal Justice.
