YANEZ, Justice.

In a trial to the court, Felimon Benitez Ibarra and Catarino Orozco Camacho were convicted of possession of more than fifty but less than two thousand pounds of marihuana, a second-degree felony. Tex. Health & Safety Code Ann. § 481.121(a), (b)(5) (Vernon Supp.1997). The court sentenced each appellant to five years in the Texas Department of Criminal Justice, Institutional Division.
