On August 8, 1997, this court directed the clerk to enter judgment against defendants for $12,600,000 in civil penalties. The court ordered the plaintiff to submit "within thirty (30) days, a proposal for the allocation of this penalty, with a specific focus on the feasibility of directing all, or part of, the penalty toward the restoration of the Chesapeake Bay and its tributaries...
