LIVINGSTON, Justice.

The December 12, 1996 order of the Court overruling appellee's motion for rehearing was withdrawn by order of January 3, 1997. On reconsideration, we overrule appellee's motion for rehearing, but we withdraw the October 31, 1996 opinion and judgment and substitute the following opinion and judgment only to clarify issues and concerns raised by the parties and amici in the motion for rehearing, response, and briefs...
