Defendant, Kim Truitt, is being prosecuted in the circuit court of Rock Island County for unlawful delivery of a controlled substance (720 ILCS 570/401 (West 1994)). The case has not yet gone to trial. The matter is before our court because the State disagrees with a pretrial ruling by the circuit court regarding how it will be required to prove that the subject material is a controlled substance.
