LEESON, Judge.

Plaintiff appeals from a judgment for defendants in a breach of contract action. ORS 19.010(1); ORS 19.020. The judgment was based on the trial court's order dismissing plaintiff's complaint1 for failure to state ultimate facts sufficient to constitute a claim. ORCP 21, A(8). We review for errors of law, Hansen v. Anderson, 113 Or.App. 216, 218, 831 P.2d 717
