A non-Indian spouse of a Yakama1 tribal member is prohibited from fishing in a treaty Indian fishery unless he or she is assisting a treaty Indian fisherman who is present at the site. The State's statute so providing is consistent with the signal cases interpreting Indian treaty fishing rights, the pertinent provisions of the Yakama tribal code, and other applicable federal law.
