In December 1995, appellant, Russell Wayne Jackson, was charged with simple battery for allegedly spitting in his wife's face during a domestic conflict. During the jury trial in October 1996, appellant's counsel attempted to raise defenses that the alleged victim either failed to take prescribed medication for her manic depression and imagined the incident or that the victim was involved in a custody dispute with appellant and fabricated the alleged...
