MAGWOOD v. STATE

No. 97-03171.

701 So.2d 615 (1997)

Donald MAGWOOD, Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida, Second District.

October 31, 1997.

NORTHCUTT, Judge.

Donald Magwood contends that the Florida Supreme Court's decision in State v. Leroux, 689 So.2d 235 (Fla.1996), is retroactive. On that premise, he argues that his motion for postconviction relief, filed more than two years after his conviction became final, nevertheless was timely because it was founded on Leroux. We disagree with Magwood's premise, and affirm the summary denial of his motion.
