WAHLS, Judge.

In Docket No. 186263, defendant was charged pursuant to M.C.L. § 750.505; M.S.A. § 28.773 with six counts of the common-law offense of misconduct in office. The district court bound defendant over for arraignment on five counts. The prosecutor appeals as of right the circuit court's order granting defendant's motion to dismiss the five remaining counts. We affirm.
