MEMORANDUM

NEWCOMER, Senior District Judge.

Presently before this Court are defendants' Motion for Sanctions Pursuant to Federal Rule of Civil Procedure 11, and in the Alternative, for Dismissal Under Federal Rule of Civil Procedure 12(b)(6), and plaintiff's response thereto, and defendants' reply thereto, and plaintiffs rebuttal to defendants' reply. For the reasons that follow, this Court grants in part and denies in part defendants' Motion.
