Rafael Dominguez brought this suit under the Age Discrimination in Employment Act of 1967, 29 U.S.C. § 621 et seq., (the "ADEA"), alleging that the Tom James Company ("the Company") fired him because of his age. After a trial, the jury returned a verdict in favor of Dominguez. The district court denied the Company's motion for a judgment as a matter of law and, alternatively, for a new trial.
