OPINION

HARDBERGER, Chief Justice.

This is an appeal of an order denying per-trial habeas corpus relief. By a single point of error Peña argues that the trial court erred in finding good cause for an untimely indictment and in failing to dismiss the prosecution with prejudice. We affirm the trial court's order.
