Decided July 15, 1997.

Attorney(s) appearing for the Case

Jack R. Kearney, Little Rock, AR, argued, for appellant.

Michael D. Johnson, Assistant U.S. Attorney, Little Rock, AR, argued, for appellee.

Before MURPHY and HEANEY, Circuit Judges, and ROSENBAUM, District Judge.
