This matter is before this court upon appeal from a judgment of the Franklin County Court of Common Pleas in which the court granted summary judgment in favor of defendant-appellee, Leslie Chernick, executor of the estate of Lisa Lelux, and against plaintiff-appellant, Keith Lelux.
