This original mandamus proceeding concerns the propriety of the trial court's order granting a new trial. Relators, Martin Flores Fuentes and Marks & Rodriguez Delivery Service, Inc., complain that respondent, the Honorable Judge Robert Garza, abused his discretion in entering an order granting a new trial on May 5, 1997, because it was entered after the court had already lost plenary jurisdiction.
