This appeal concerns the quality of evidence that may support a finding of uncharged criminal conduct relied upon by a sentencing judge to increase a sentence beyond the punishment appropriate for the offense of conviction. The issue arises in the frequently litigated context of determining the quantity of drugs attributable to a defendant for purposes of sentencing under the "relevant conduct" provision of the Sentencing Guidelines.
