Prior to being sentenced as an armed career criminal under 18 U.S.C. § 924(e)(1) and (e)(2)(A)(ii) (the "Armed Career Criminal Act"), Edwin J. Gunn ("Gunn") moved to exclude three of his prior offenses from consideration under that Act.
