Defendant was convicted following a jury trial of murder in the second degree (Penal Law § 125.25 [3]), burglary in the first degree (Penal Law § 140.30), petit larceny (Penal Law § 155.25), and criminal mischief in the fourth degree (Penal Law § 145.00).
