This action is brought by Duane F. Svehla, personal representative of the estate of Marjorie Ella Svehla, against Beverly Enterprises, doing business as Colonial Manor (Colonial Manor). A single judge of the Workers' Compensation Court dismissed the petition after finding that Duane failed to prove that Marjorie's injuries were caused by an accident arising out of her employment.
