The issue presented is whether the New York County District Attorney has the statutory authority to prosecute these matters in which the sole crime charged is attempted unauthorized practice of a profession in violation of section 6512 of the Education Law.

Claiming that he does not, defendant moved for an order dismissing the informations for lack of jurisdiction.
