FACTS

Larry Cunningham ("Cunningham") obtained a judgment exceeding $140,000 in compensatory and punitive damages against Ceresa Rothery ("Rothery"). Cunningham then conducted a debtor's examination on February 8, 1996. He discovered that in October 1995, after Rothery's husband died, Rothery received over $500,000 in insurance proceeds.
