The appellant, David Ray Mulkey, was charged with capital murder for killing his former stepmother, Martha "June" Barnes. Following a jury trial, he was found guilty of first-degree murder and sentenced to life imprisonment. On appeal, appellant's two points for reversal are a challenge to the sufficiency of the evidence and a challenge to the use of a prior conviction to enhance his sentence.
