PITTMAN, Justice, for the Court:

On July 14, 1988, the grand jury of Neshoba County, Mississippi, indicted Michael Parker for capital murder in the forcible rape and murder of Rachel Morgan. The case was initially tried by a Neshoba County jury and a guilty verdict was rendered on October 19, 1989. The case was then appealed to this Court and was reversed and remanded, based on an evidentiary matter, on August 31, 1992. See Parker v. State,
