TERRY, Associate Judge:

Appellant Spencer and a co-defendant, Bernard Bishop, were convicted of distributing cocaine, in violation of D.C.Code § 33-541(a)(1) (1993). Spencer noted an appeal from his conviction.1 While that appeal was pending, he filed a motion to vacate his sentence under D.C.Code § 23-110 (1996).
