LÓPEZ, Justice.

We grant Appellant's motion for rehearing, withdraw our opinion of March 26, 1997, and substitute this opinion in its place.

Appellant, Jacob Anthony, was indicted for the offense of murder. Pursuant to a plea agreement, the trial court sentenced Appellant to fifty years confinement.
