Before the Court are the defendant's Motion to Vacate, Set Aside, or Correct his Sentence Pursuant to 28 U.S.C. § 2255 and the government's Opposition thereto. The defendant was convicted of possessing with the intent to distribute five (5) grams or more of cocaine base, pursuant to 21 U.S.C. § 841(a)(1) and (b)(1)(B)(iii). On August 26, 1991, the Court sentenced the defendant to 108 months...
