We conclude that the First Circuit Court (circuit court) abused its discretion when it dismissed the indictment against Defendant-Appellee Damien Chong, also known as Damien Suzukawa, (Defendant) because the State of Hawai`i (the State) had given each witness who testified before the grand jury (1) the questions which would be asked of the witness during the grand jury proceeding, and (2) the anticipated responses of the witness as gleaned from the...
