Wiles, 102 F.3d 1043 (10th Cir.1996), reh'g in part 106 F.3d 1516 (10th Cir.1997), we affirmed Defendant Patrick Schleibaum's conviction on one count of securities fraud in violation of 15 U.S.C. §§ 78j(b)m 78ff(a), and 17 C.F.R. § 240.10b-5 but vacated his conviction on one count of making false statements to the government...
