OPINION

FOWLER, Justice.

Appellant, University of Houston ("UH"), appeals from a motion for summary judgment in favor of Appellee, Sterling Bank (F/K/A Enterprise Bank) ("Sterling Bank"). We affirm the trial court judgment.
