OPINION

SULLIVAN, Judge.

Appellant Javier Zayas (Zayas) appeals the trial court's July 20, 1995, order granting appellee Gregg Appliances, Inc. d/b/a H.H. Gregg Appliances' (Gregg) motion to dismiss.

We affirm.

The sole determinative issue is whether or not the trial court erred in granting Gregg's motion to dismiss for lack of subject matter jurisdiction.
