DRUKE, Chief Judge.

The trial court dismissed the complaint of appellant Perry Kyles on the grounds that his state and federal claims of racial discrimination were time barred and that his remaining causes of action failed to state claims for relief. We publish only the portion of our decision that reinstates the discrimination claims.1 Fenn v. Fenn, 174 Ariz. 84,
