Defendant and Timothy Platt were both incarcerated in the Broome County Jail. While incarcerated, defendant stole a gold chain and medallion in the possession of Platt and, when Platt attempted to recover his property, defendant hit him repeatedly, fracturing his jaw, nasal bone and maxillary sinus area.
