LEGG, District Judge.

Before this Court is defendant's Motion for Summary Judgment. For the reasons set forth below, this Court shall GRANT IN PART and DENY IN PART, by separate Order, defendant's motion.

Background

In his Complaint, plaintiff, Anthony Maxwell Powell, alleges that Corporal John Appleby of the Maryland State Police violated his Fourth Amendment and Fourteenth Amendment rights.1
