The appellant, Michael Steven Mitchell, was indicted for three crimes relating to the death of Danny Hucks. Count 1 of the indictment charged Mitchell with the malice murder of Hucks; Count 2 charged him for the felony murder of Hucks, with aggravated assault as the underlying felony; and Count 3 charged him with the possession of a firearm during the commission of a crime. On the malice murder count, the jury found Mitchell guilty of voluntary manslaughter...
