LUMBARD, Circuit Judge:

The government appeals from an order entered on July 27, 1995 in the District Court for the Southern District of New York (McKenna, J.), dismissing with prejudice the indictment against Clarence Jones, under the Sixth Amendment's Speedy Trial Clause and Federal Rule of Criminal Procedure 48(b).
