Emmel Tolston brought this action against her former employer, the National Railroad Passenger Corporation, known more familiarly as Amtrak, under the Federal Employers' Liability Act, 45 U.S.C. §§ 51-60, alleging severe and permanent injuries to her knees as a result of Amtrak's negligence. The district court granted Amtrak's motion for summary judgment on the ground that Tolston's action was barred by the FELA three-year statute...
