Plaintiff appeals from a judgment dismissing its complaint for failure to allege ultimate facts sufficient to constitute claims for negligent misrepresentation, contribution, and indemnity against defendant. ORCP 21A(8). We affirm.

We state the facts as alleged in the complaint. McAlpine v. Multnomah County, 131 Or.App. 136, 883 P.2d 869 (1994), rev. den.
