Jenoff, Inc., was sued for damages allegedly resulting from its installation of a heat detection and fire suppression system. The damages occurred in 1993, as a result of a fire.

Jenoff tendered its defense to New Hampshire Insurance Company, which had insured Jenoff at the time it installed the system in 1976. New Hampshire Insurance Co. refused coverage, and Jenoff sought a declaration of coverage under the policy. The district...
