John and Melinda Cason signed a contract to purchase a house from David Govus for $575,000. The sale of the house, however, was not consummated. Century 21 Pinetree Properties, Inc., Govus's broker, sued the Casons to recover its entire $46,000 broker's commission, based on the contract term providing that the Casons agree to pay the full commission if they fail or refuse to perform any of the buyers' covenants in the contract.
