Sassafras Enterprises, Inc. ("Sassafras") has sued Roshco, Inc. ("Roshco") for trade dress infringement and unfair competition under Lanham Act § 43(a), 15 U.S.C. § 1125(a) (Count I), contending that Roshco's pizza stone set infringes on the trade dress of Sassafras' set containing the same components. Sassafras also asserts that the same conduct on which it pegs its Lanham Act...
