Ordered that the order and judgment is reversed, insofar as appealed from, on the law, with costs, the branch of the plaintiff's motion which was, inter alia, for summary judgment to compel the defendants to remove the name and shamrock is denied, and the complaint insofar as it seeks relief against the defendants for the painted name and shamrock is dismissed.
