On 11 December 1992, plaintiff Tracy Patterson suffered an injury by accident arising out of and in the course of his employment when he fell from a scaffold while working for defendant Markham & Associates ("Markham"). Plaintiff's accident occurred on a project that defendant Sunstar Homes ("Sunstar")—the principal contractor—had subcontracted Markham to perform carpentry work on the Village Lake Subdivision in Wake County, North Carolina...
