Ordered that the order is reversed, on the law, with costs, the plaintiffs' motion is denied, the cross motion is granted, and the complaint is dismissed.

On March 11, 1991, the plaintiff Arthur Sherwood served a notice of claim upon the New York City Transit Authority alleging property damage to his car arising out of a December 1, 1990, accident. In April 1991 he settled his property damage claim by executing a general release of all claims arising from the accident...
