The plaintiff, Perry S. Gradford, appeals from the trial court's denial of his motion for a new trial. Gradford contends that he is entitled to a new trial because, he says, the trial court incorrectly charged the jury as to his burden of proof. Our supreme court transferred the appeal to this court pursuant to § 12-2-7(6), Ala.Code 1975. We affirm.
