The United Transportation Union (UTU) appeals the district courts denial of its motion for summary judgment in a suit brought by two of its member railroad workers, Jesse Fulk and Donald Cearlock. The plaintiffs challenged the voting method employed by the Union to dispose of certain "productivity funds."
