Ordered that the order and judgment is modified, on the law, by deleting therefrom the provision which declared that the New York State laws imposing mandates from the State upon the Counties are constitutional and valid under both the United States and New York State Constitutions, and substituting therefor a provision dismissing the complaint in all respects; as so modified, the order and judgment is affirmed, with one bill of costs to the respondents payable by the appellants...
